This Privacy Policy explains how Prodigy Property Management Inc., doing business as Prodigy Host Academy ("PHA" or "Company") collects, shares, protects, and uses information when you use our website and any related websites, applications, and platforms where this Privacy Policy is posted (collectively, the "Services"). Please read this Privacy Policy carefully. By using our Services, you acknowledge you have read and understand the terms of this Privacy Policy and our separate Terms of Service. If you do not agree, you may not use or access the Services. Terms not defined in this Privacy Policy have the same meaning as in the Terms of Service.

This Privacy Policy only applies to the Services, and not to websites, applications, or platforms of third parties (collectively, "Third-Party Platforms"), even if such Third-Party Platforms are linked to or accessible from the Services. Each Third-Party Platform has its own data collection and usage practices and may use its own cookies, web beacons, and other technology to collect information from you. We are not responsible for the content or practices of any Third-Party Platforms and, if you choose to visit or use them, including if you purchase third-party goods or services or click to be redirected to third-party websites, you do so at your own risk.

Some Services, such as student community groups, may allow users to create and post content ("Content") viewable by other users. Users should not post any Content that is private. PHA is not responsible for Content.

1. Who controls your information?

2. What types of information do we collect?

"Information," as used in this Privacy Policy, means personal information that can be used to identify, locate, describe, or contact an individual, or as otherwise defined by applicable laws. We may collect information from or about you in a number of ways. If you decline to provide any of the requested information (whether or not required), you may not be able to take full advantage of the Services and their features or make a purchase from us.

Over the past twelve (12) months we have collected, or may collect, the following categories of information about you and other users of the Services:

  • Information you provide. We collect information from you and about you and your transactions and other interactions with us, including when you register for the program, post Content, make a purchase, or sign up for our email list. For example, you may be asked to provide your first and last name, email address, birth date, and phone number. Some of this information may constitute identifiers, such as your name, and/or protected class information, such as your gender and age.
  • Content you make public. We collect information you voluntarily post to the Services for display to others, such as posts, comments, photos, videos, and text. Once you make information public, neither you nor Company can control how it may be copied, shared, or used by third parties, even if you and/or Company later delete it, so carefully consider what information you choose to make public.
  • Transaction and payment information. We collect information as needed to process payments for the program or other products or services you buy, such as your payment card number, expiration date, and card verification number. Payments are handled by third-party payment processors, which process your payment information under their own privacy policies. We do not store full payment card numbers on our own systems.
  • Commercial information. We may collect information relating to the interests and activities of users, including purchase history and information about people who refer you or whom you have referred.
  • Device and internet connection information. When you use the Services, we automatically gather information made available by your device, web browser, and internet service provider, depending on your settings for each. This may include your device model, operating system version, advertising identifiers, unique device identifiers, browser type, language, and time zone. We may also collect information related to any social media accounts that you link to the Services and from any of Company's partners that integrate with the Services through an API.
  • Internet activity information. When you interact with the Services, we may collect information such as server logs, access dates and times, operating system, browser type, IP address, languages, clicks, views, search terms, pages viewed, time spent on pages, and information regarding your interaction with a particular website, application, or advertisement, including the Services.
  • Protected class information. You may be asked to provide your age to confirm your eligibility to use the Services.
  • Location information. We collect information about where you are located generally, such as your province or state, city, or neighbourhood, and, if you agree, more specific location information provided through the location features of the device you use to access the Services.
  • Other information. From time to time, we may collect other information from you, such as when you request assistance from our support team, or when you voluntarily subscribe to promotions, reminders, or newsletters.
  • Inference information. We may create new information about you by drawing inferences from the information identified in the categories above, such as a profile reflecting your preferences.

3. How and when do we collect information about you?

Company gathers information about you through the following sources and means:

  • When you provide information through the Services. Company collects information when you voluntarily enter or upload it, including when you upload Content, make a purchase, register for the program, sign up for emails, or save account or payment preferences.
  • Through your communications. Company may collect information from you outside of your use of the Services, such as when you email us, speak with us on a consultation or coaching call, or communicate with us over social media. Information collected outside your use of the Services may be combined with information collected through your use of the Services.
  • Through cookies, tracking tools, and automated technologies. We may use various technologies to collect and store information when you use, access, or interact with the Services, including cookies (small files placed on your device by websites you visit) and web beacons. We may use the following types of cookies, some of which are placed by Third-Party Platforms: essential cookies that allow the Services to function; preference cookies that remember your settings; analytics cookies that help us understand how the Services are used; and advertising cookies that help us show you relevant ads and measure their performance.

You can change your cookie settings in your internet browser (e.g. Chrome, Edge, Firefox, Safari). However, if you disable cookies, some features of the Services may not function correctly. For more information, see allaboutcookies.org.

Social media networks. You may give us permission to access your information from services offered by third parties, including social media networks. The information we obtain depends on your account and privacy settings with those third parties and their privacy policies. When you access the Services through social media networks and other Third-Party Platforms, you authorize PHA to collect, store, and use such information and content in accordance with this Privacy Policy.

From third parties. We may collect information from third parties, including device and internet connection information, internet activity information, and location information. Third parties may also place cookies and pixels on our website, and these companies may use that data to show you more relevant advertisements and promotions. These may include Facebook/Instagram and Google/YouTube. You can learn more about controlling your privacy settings on those platforms' websites.

We may use Google Analytics to collect usage data and analyze how you use the Services. To opt out, you can use the Google Analytics Opt-out Browser Add-on. 4. How do we use your information?

We use information to provide and improve the Services, deliver the program, personalize your experience, communicate with you, fix technical problems, and protect our students and business. Specifically, Company may use the information we've gathered for the following purposes:

Business purposes, meaning uses reasonably necessary and proportionate to operate our business:

  • Delivering the program, including course access, coaching calls, and community groups
  • Processing enrolments, payments, and payment plans
  • Responding to questions and providing student support
  • Maintaining the security of the Services and detecting and preventing fraud
  • Debugging and fixing technical problems
  • Keeping business, accounting, and tax records and complying with legal obligations

Commercial purposes, meaning uses intended to advance our business interests:

  • Sending marketing emails and other promotional communications, with your consent
  • Showing advertisements and measuring how well they work
  • Researching and developing new program content and offerings

Scope and legal bases for use. Company only processes your information to the extent necessary to accomplish the purposes above. Our bases for processing include (a) legal purposes, such as resolving legal disputes or investigations; (b) performance of a contract, including pre-contractual steps, such as delivering the program you enrolled in; (c) our legitimate interests, such as showing advertising that may interest you; and (d) your consent, such as when you give us your email address to receive marketing emails.

5. How do we share your information?

No mobile information will be shared with or sold to third parties or affiliates for marketing or promotional purposes.

Company may share your information with third parties as follows:

  • Service providers who help us operate the business, such as website hosting, payment processing, customer relationship management, email delivery, scheduling, video conferencing, course hosting, and analytics providers. They may use your information only to provide services to us.
  • Professional advisers, such as lawyers and accountants, where needed.
  • Legal compliance, where required by law, court order, or government request, or to protect the rights, property, or safety of Company, our students, or others.
  • Business transfers, in connection with a merger, sale of assets, financing, or acquisition of all or part of our business.
  • With your consent, or at your direction.

6. Do we sell your information to others?

No. Company does not sell your personal information.

7. How do we protect your information?

Company uses technical, administrative, and physical security measures designed to protect against the loss, misuse, and alteration of the information under our control. However, no system can be completely secure. Although we take steps to secure your information, we cannot promise, and you should not expect, that your personal and commercial information or other communications will always remain secure. The safety of your information also depends on you. Never share your login credentials with anyone else, and tell us as soon as possible if you believe your account security has been breached.

8. How long do we keep your information?

Company will retain your information for as long as necessary to fulfil the purposes outlined in this Privacy Policy, unless a longer retention period is required or permitted by law or valid court order. We may also delete your information, Content, or account if it violates our Terms of Service or any applicable terms or policies.

9. Do we transfer your information to a different country?

Some of our service providers store and process information outside Canada, including in the United States. Information stored outside Canada is subject to the laws of that country and may be accessible to its courts, law enforcement, and national security authorities.

10. What are your rights, and how can you exercise them?

If you are in Canada, you have the right under British Columbia's Personal Information Protection Act and, where it applies, the federal Personal Information Protection and Electronic Documents Act, to request access to the personal information we hold about you, to ask us to correct it, and to withdraw your consent to our use of it, subject to legal and contractual limits. We respond to requests within 30 days.

Under certain other privacy laws, such as the California Consumer Privacy Act (CCPA) or similar laws, if they apply to you, you may also request to correct, amend, access, or delete information. You can make any of these requests by emailing support@prodigyhostacademy.com with "Privacy" in the subject line. To protect your privacy, we may take reasonable steps to verify your identity before granting your request, and to verify any authorized agent making a request on your behalf. Where such laws apply to you:

  • Access and correction: You have the right to access and correct information.
  • Disclosure: You have the right to request that we disclose the categories of information we have collected about you; the categories of sources from which it was collected; the business or commercial purpose for collecting it; the categories of third parties with whom we share it; and the specific pieces of information we have collected about you.
  • Opt-out: You have the right to opt out of certain privacy practices, including the sale of your information, if any.
  • Deletion: You have the right to request deletion of your information, subject to applicable laws. If you have shared information with other users or posted it publicly, we will not be able to delete third-party access to it.
  • Restriction of processing: You have the right to restrict processing of information, so that it is marked and only processed for certain purposes.
  • Data portability: You have the right to receive the information you have provided to us in a structured, commonly used, machine-readable format and to transmit it to another entity.
  • Objections: You have the right to object, on grounds relating to your particular situation, to the processing of your information, including processing for direct marketing.
  • Withdraw consent: If you have consented to any processing, you can withdraw that consent at any time with future effect. Withdrawal does not affect the lawfulness of processing before it.
  • No discrimination: We will not discriminate against you for making a privacy request or asserting privacy rights.
  • Complaints: You may lodge a complaint with a competent supervisory authority. In British Columbia, this is the Office of the Information and Privacy Commissioner for British Columbia. Federally, it is the Office of the Privacy Commissioner of Canada.
  • California "Shine the Light": California residents who provide information to the Services may request certain information about our disclosure of information to third parties for their direct marketing purposes.

11. Privacy practices of third parties

This Privacy Policy only addresses the use and disclosure of information by Company through your interaction with the Services. Third-Party Platforms that may be accessible through links from our Services have their own privacy policies and practices, as do third-party sellers, advertisers, and partners. We encourage you to read those privacy statements before providing information to them or taking advantage of a third-party offer.

12. How do we protect the privacy of children?

The Services are intended for adults. Company does not knowingly collect personal information about children under the age of 13, and if we learn that we have, we will delete it. We have designed this policy to comply with the Children's Online Privacy Protection Act (COPPA).

13. How can you opt out of marketing communications?

By providing your contact information through the Services or in communications you start, you consent to receive communications from us, including by email, text message, and phone call, including information about your enrolment and advertising messages. Consent to promotional communications is not a condition of purchasing any goods or services. You can unsubscribe from advertising communications at any time by following the unsubscribe instructions in each message or contacting us. Even if you unsubscribe, we will still send necessary, non-promotional messages about your purchases, enrolment, or updates to our Privacy Policy and Terms of Service.

14. Do we respond to Do Not Track signals?

Do Not Track is a browser feature that asks websites not to track your browsing. Company does not currently respond to Do Not Track requests.

15. How will you know when we change this Privacy Policy?

Each time you use the Services, the then-current version of this Privacy Policy applies. We may modify this Privacy Policy at any time by posting the modified version on the Services, so please review it periodically. Unless we receive your express consent, any revised Privacy Policy will only apply to information collected after its effective date.
